The purpose of this notice is to inform you about what personal data we process about you and for what purposes. Personal data refers to any information relating to an identified or identifiable natural person. The law refers to this person as the ‘data subject’.

Purposes of data processing

Vertragserfüllung

We process your personal data – specifically your surname, first name, address details, contact details (email address, telephone number, mobile number) and, where applicable, financial details (bank account details) – if you have entered into contracts with us for our services.

The legal basis for this data processing is Article 6(1)(b) of the GDPR. Under this provision, data processing is permitted for the purpose of fulfilling contracts concluded with you and, where you have contacted us, for the purpose of taking pre-contractual steps at your request.

Kontaktformular

When visitors use the contact form on our website, we process the data provided in the form, as well as the visitor’s IP address and user-agent string (which identifies the browser), in order to help detect and, where necessary, block spam. The data is transmitted to us in unencrypted form.

The legal basis for data processing in connection with the use of our contact form is Article 6(1)(b) of the GDPR (performance of a contract)

If the enquiry is not made for the reasons set out above, the legal basis for the processing is Article 6(1)(f) of the GDPR. This provision allows us to process data where it is in our legitimate interests to do so, provided that your interests in not having your data processed do not override those interests. Our legitimate interest in processing your data in the context of establishing contact is to respond to your enquiry.

Furthermore, it is in our legitimate interest to prevent spam emails in order to conserve our IT resources.

Cookies

We use cookies on our website. A cookie is a small, simple file that is sent along with the pages of this website and stored by your browser on the hard drive of your computer or other device. The information contained in cookies can be sent back to our servers when you visit the site again. Cookies cannot run programmes or place viruses on your computer.

We use both technically necessary cookies and a statistics cookie. The legitimate interest lies in the fact that it would not be possible to provide the website without setting these cookies, and that the services you may request via our website could not be offered.

Recipients of your data

We only disclose your personal data to the service providers we use in the context of data processing on our behalf.

Duration of storage / Criteria for the duration of storage

We store your personal data until the purpose underlying the processing (see → Purposes of data processing) no longer applies. Where we are legally obliged to store personal data, we will do so for the duration of that legal obligation. This may be up to eight years (e.g. Section 257(4) of the German Commercial Code; Section 147(3) of the German Fiscal Code). Where applicable, your data will be blocked for day-to-day operations during this period, provided there is no longer any other purpose for processing it.

Rights of data subjects

Rights under Articles 15–18 and 20 of the DSGVO

You have the right to request, at reasonable intervals, information from us regarding your stored personal data and a copy of the data being processed (Art. 15 DSGVO).

In addition, you have the right to request that we rectify any data we have stored incorrectly (Article 16 of the DSGVO).

You also have the right to request that we erase your personal data (Article 17 of the DSGVO). We are obliged to erase your personal data, among other things, if it is no longer necessary for the purposes for which it was collected or otherwise processed, if you have withdrawn your consent, or if the data has been processed unlawfully.

Under certain circumstances, you have the right to restrict the processing of your personal data (Article 18 of the DSGVO). This includes situations where you contest the accuracy of your personal data and we are required to investigate your objection. In such cases, we may not process your data further – with the exception of storage – until the issue of accuracy has been resolved.

You also have the right to request that we provide you with the data you have supplied to us on the basis of your consent or a contractual relationship between us in a machine-readable format, or – at your discretion – transfer it to a third party (right to data portability, Article 20 of the DSGVO).

No contractual or legal obligation to provide the data / Consequences of failure to provide the data

You are under no contractual or legal obligation to provide us with your personal data. Please note, however, that you will not be able to enter into a contract with us for the provision of our services if we are not permitted to process the data we require for the purposes stated (see → Purposes of data processing).

Right to object at any time in accordance with Article 21 of the DSGVO

If the processing of your data by us is based on the performance of a task carried out in the public interest or in the exercise of official authority (Article 6(1)(e) of the DSGVO), or if the data processing is based on our legitimate interests, you have the right to object to the processing of your personal data at any time on grounds relating to your particular situation. We will then cease processing, unless we can demonstrate compelling legitimate grounds for the processing which override your interests in having the processing ceased.

You may object to the processing of your personal data for direct marketing purposes at any time and without restriction.

Right to withdraw consent at any time

If our processing of your data is based on your consent, you have the right to withdraw your consent at any time. The lawfulness of the processing carried out on the basis of your consent up until the time of withdrawal remains unaffected by the withdrawal.
